TERMS AND CONDITIONS - CUSTOMER


1. Introduction

1.1. These terms and conditions (hereinafter referred to as "Terms") govern the relationship between Maid 2 Touch (hereinafter referred to as "Company," "we," "us," or "our") and the client (hereinafter referred to as "Client," "you," or "your").

1.2. By booking our cleaning services, you agree to abide by these Terms.

2. Services

2.1. We will provide cleaning services as described in the service agreement or estimation provided to the Customer.

2.2. The Client is responsible for providing accurate information about the property to be cleaned, including any special requirements or areas that require special attention upon the booking of cleaning service.

3. Pricing and Payment

3.1. The pricing for our services will be specified based on the details provided by the Client and estimations will be provided to the Client.

3.2. The client acknowledges that 24 hours before the scheduled cleaning, the full-service fee will be placed on hold on your credit card to ensure your card has sufficient funds available. If your credit card is declined, we will make reasonable efforts to contact you to update your payment details.

3.3. Payment is due and processed upon completion of the cleaning service.

4. Arrival Window

4.1 The Client acknowledges that the Company's cleaning professionals will arrive within a one-hour window of the scheduled appointment time. While we make every effort to adhere to the specific appointment time, slight variations may occur due to unforeseen circumstances, such as traffic or prior appointments taking longer than expected.

5. Cancellation and Rescheduling

5.1. The Client must contact us 24 hours prior to the cleaning schedule for any cancellation or rescheduling. Failure to provide proper notice may result in a cancellation or rescheduling fee of $50.

5.2. In the event of a client-initiated cancellation, rescheduling, or inability to provide home access on the scheduled cleaning day, a $50 fee will be applied. Similarly, if our cleaner arrives for a scheduled cleaning appointment but encounters access issues, a $50 fee will be incurred by the client.

5.3. The Company retains the right to reschedule or cancel appointments in case of unforeseen circumstances, such as equipment failure or staff unavailability.

6. Liability and Damages

6.1. We will take reasonable care when providing its Services. However, the Customer acknowledges that cleaning may involve some risk, and the Company shall not be liable for any damage or injury unless caused by negligence on the Company's part. The Client is responsible for putting away any fragile items before our Team arrives for the cleaning.

6.2. The Client must report any damages or issues within 24 hours of service completion.

7. Insurance and Safety Policy

7.1. We maintain appropriate insurance coverage, including liability insurance, to cover any accidents or damages incurred during our cleaning services.

7.2. To maintain the safety of both our cleaners and Clients, and adhere to insurance regulations, we will not be able to move any furniture or appliances, particularly items such as beds, couches, and stoves, during our cleaning service. We will make every effort to clean around these items if accessible. However, if there is furniture or an appliance that weighs less than 25 pounds and you would like it moved, we can assist with this request, provided that the client or an authorized party is present at the time.

7.3 To ensure our cleaners’ safety, they must wear suitable protective equipment, avoid climbing ladders over 3 feet, and refrain from lifting objects over 20 pounds. We do not clean hazardous substances like bodily fluids or pet accidents. The Company may remove an employee from a job site if safety or integrity concerns arise.

8. Satisfaction Guarantee and Reclean

8.1 Maid 2 Touch is dedicated to ensuring customer satisfaction with our cleaning services. If you are not entirely satisfied with the Services provided, please promptly notify us within 24 hours of the completion of the cleaning. If there are areas that you feel we may have missed, we kindly request that you refrain from cleaning them yourself.

8.2 Upon receiving notice of dissatisfaction, we will make every reasonable effort to address the issue to the Client's satisfaction. The Company may offer a "reclean" of the specific areas or items in question. The reclean will be scheduled at a mutually agreed-upon time, and the Company will strive to rectify any identified deficiencies to the best of its abilities.

9. Confidentiality

9.1. The Company agrees to keep all Customer information and keys or access codes provided confidential.

10. Termination

10.1. Either party may terminate the cleaning agreement with prior notice.

11. Governing Law

11.1. These Terms are governed by the laws of New York, United States.

12. Amendments

12.1. We reserve the right to amend these Terms at any time. Notice of amendments will be provided to the Client.

13. Severability

13.1. If any provision of these Terms is found to be invalid or unenforceable, the remainder of the Terms shall remain in full force and effect.

14. Entire Agreement

14.1. These Terms constitute the entire agreement between the parties and supersede all prior agreements and understandings.

By booking our cleaning services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

TERMS AND CONDITIONS - CLEANER

1. Introduction

1.1 These terms and conditions ("Agreement") govern the working relationship between Maid 2 Touch LLC (referred to as the "Company") and the independent contractor cleaner (referred to as the "Cleaner").

1.2 By entering into this Agreement, both parties acknowledge their understanding of and agreement to the terms and conditions outlined herein.

2. Independent Contractor Status

2.1 The Cleaner acknowledges and agrees that they are an independent contractor, not an employee of the Company. The Cleaner is solely responsible for all applicable taxes, including income, self-employment, and any other tax obligations.

3. Scope of Services

3.1 The Company will provide the Cleaner with cleaning assignments, including details such as location, schedule, and the specific cleaning type needed.

3.2 The Cleaner will provide the agreed-upon cleaning services efficiently and in accordance with the Company's standards.

3.3 The Cleaner may accept or reject assignments based on their availability and discretion.

4. Compensation


4.1 The Company will pay the Cleaner according to the agreed-upon compensation terms, which may include hourly rates, flat fees, or other arrangements. Payment terms and schedules will be agreed upon individually.

4.2 The Company will not provide benefits, insurance, or other employment-related perks, as the Cleaner is an independent contractor.

5. Equipment and Supplies

5.1 The Cleaner is responsible for providing the equipment, tools, and transportation required to perform the services. The Company will not reimburse for any such expenses.

6. Confidentiality

6.1 The Cleaner shall maintain strict confidentiality regarding all customer information and any information obtained during their work with the Company.

7. Compliance with Laws

7.1 The Cleaner agrees to comply with all federal, state, and local laws, regulations, and ordinances relevant to their independent contractor status, including safety regulations and licensing requirements.

8. Liability and Insurance

8.1 The Cleaner is responsible for maintaining their liability insurance covering any accidents, injuries, or damages that may occur during the cleaning service.

9. Termination


9.1 This Agreement may be terminated by either party with written notice as agreed upon between the Company and the Cleaner.

9.2 The Cleaner may also terminate the Agreement immediately in case of non-payment, breach of this Agreement, or any other serious misconduct by the Company.

10. Dispute Resolution

10.1 In the event of any disputes or claims arising from this Agreement, both parties agree to first attempt to resolve the matter amicably through negotiation.

11. Entire Agreement

11.1 This Agreement constitutes the entire agreement between the Company and the Cleaner and supersedes any prior understandings, written or oral.

12. Amendments

12.1. We reserve the right to amend these Terms at any time. Notice of amendments will be provided to the Cleaner.

13. Governing Law

13.1 This Agreement shall be governed by and construed in accordance with the laws of New York, United States.

14. Severability

14.1 If any part of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
